Rule 6
Budget and construction site arrangements
(1) The public body should not initiate the procurement process without the necessary budget arrangement for procurement.
(2) Notwithstanding anything written in sub-rule (1), procurement proceedings may be initiated even if there is no budget provision in the following cases:--
(a) In the case of procurement to be done according to the multi-year agreement, after the necessary budget arrangement for the first year, to take procurement action for other years, and
(b) It is essential to make preliminary preparations related to procurement, to call for sealed bids or bids, to call for applications for pre-qualification, to publish notices to prepare a list of consultants, to request proposals from consultants or to form sealed bids, bids or documents related to pre-qualification or documents related to proposals. (3) The public body should not call for bids without the arrangement of the construction site, without ensuring the removal of structures such as trees and plants to be removed from the construction site, without ensuring the budget for the compensation or compensation distribution, and without approving the report of the environmental study to be done in accordance with the prevailing law.
(4) Notwithstanding anything contained in sub-rule (3), there shall be no bar to calling for bids pending approval of the environmental study report in the following cases:-
(a) Sub-rule (3) in case of execution of a project which has been approved at the time of commencement,
(b) If there is a decision by the Government of Nepal, the Council of Ministers to implement a particular project.
(5) In the case of procurement to be carried out under multi-year contracts, the public body shall start the procurement process only by ensuring the necessary budget for other years in accordance with Clause (a) of sub-rule (2).
